1. Overview
These Terms of Service govern access to and use of the website located at https://www.divineproducts.club/ and related services operated by Divine Product Solutions LLC. The platform operates as an online marketplace connecting buyers and independent sellers. Unless expressly stated otherwise for a specific listing, Divine Product Solutions LLC is not the seller of record for third-party listings and does not take title to products sold by third-party sellers.
2. Eligibility and Accounts
You must be at least 18 years old and legally capable of entering into binding agreements to use the marketplace. You are responsible for maintaining the confidentiality of your account and for all activity under your account.
3. Marketplace Role
Divine Product Solutions LLC provides the software platform, discovery tools, checkout infrastructure, and related marketplace services. Sellers are responsible for their listings, pricing, descriptions, compliance, fulfillment, returns where applicable, and customer service obligations unless expressly stated otherwise.
4. Payments and Processing
Payments on the platform are processed through Stripe and related providers. By using the marketplace, you agree to comply with applicable payment processing rules and any additional identity, verification, reserve, payout, or risk requirements that may apply to buyers or sellers.
5. Prohibited and Restricted Listings
You may not list, offer, sell, advertise, or otherwise transact in any product or service that is illegal, infringes the rights of others, or is prohibited or restricted by our payment processors or financial partners. This includes any item or category prohibited by applicable law or Stripe’s prohibited and restricted business rules. Examples include illegal drugs, drug paraphernalia, counterfeit or infringing goods, stolen goods, certain adult content or services, weapons and certain weapon-related items, hazardous materials, and unauthorized medical or pharmaceutical products.
6. Listing and Content Standards
You are solely responsible for the accuracy, legality, and completeness of your listings and any content you upload. We may remove, restrict, edit, or reject listings or content at our discretion to address risk, compliance, trust and safety, payment processor requirements, or legal concerns.
7. Orders, Cancellations, and Disputes
Orders may be canceled or delayed where necessary to address fraud, verification issues, compliance reviews, seller performance issues, or product restrictions. We may facilitate dispute workflows, but we are not required to resolve every dispute in a particular way and may take any action reasonably necessary to protect the platform, users, and financial partners.
8. Suspension and Termination
We may suspend, limit, hold funds associated with, or terminate accounts or listings at any time where we believe a user has violated these terms, created risk, triggered payment processor concerns, or exposed the platform or its users to fraud, legal, regulatory, or reputational harm.
9. Disclaimers and Limitation of Liability
The marketplace is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties and are not liable for disputes between buyers and sellers, listing accuracy, product quality, shipping delays, third-party conduct, or indirect or consequential damages arising from marketplace use.
10. Changes to These Terms
We may update these terms from time to time. Continued use of the marketplace after changes become effective constitutes acceptance of the updated terms.
